Terms: Initiation and Completion of Project:

1) Logo Design Works will begin creation of a corporate identity logo design (THE PROJECT) upon receipt of a project details and 100% package fee payment. Once we show THE CLIENT the initial custom logo design concepts, the client has 48 hours to tell us if they would like to continue the project or if they would like to cancel the project. If they would like to proceed or do not respond with in 48 hours, all refund policies will be void. To cancel the project a valid reason must be given. If the client wants to cancel the project at the initial concepts stage, a refund will be give as per the package refund policy. The amount refunded will be shown in each package details page. BRONZE and SILVER packages do NOT include any refunds. If THE CLIENT does not communicate with us in any way with in the 48 hours about the project, then THE COMPANY will issue no refunds. Any refund policy is only valid for retail clients. All partners, resellers, companies acting on behalf of their clients will NOT be entitled to any refunds.

2) Upon completion of THE PROJECT, Logo Design Works agrees to transfer electronic files relating to the FINAL DESIGN of THE PROJECT to THE CLIENT via download ONLY from LDW website or email. LDW retains the copyrights to all other designs resulting from THE PROJECT except the FINAL DESIGN. The final files will be archived. If the client wishes access to the final files at any time in the future a small fee will be charged to un-archive the files and made available to the client.

3) Once THE CLIENT selects a concept to continue the project, there is no turning back. We can not go back to a different concept or provide any more new concepts. We can only continue revising the selected concept.

Terms: During Project Life Cycle

4) If THE CLIENT does not provide any feedback or response to Logo Design Works at any stage of the design process within 4 days, THE PROJECT will be deactivated and re-activation of the project will cost an additional amount ($100+).

5) After a project has started, if the client does not communicate with LDW for more than 5 business days, the project will be deemed complete, and any remaining balance will be charged. To reactivate such a project would mean a fresh project fees should be paid. Also once a project is completed and the client requests for the final files no more edit requests will be entertained unless they are paid for. It is the responsibility of the client to be aware of these time restrictions and act accordingly. No alerts or warnings shall be given by Logo Design Works.

6) Further, if THE CLIENT, after 2 days from project submission, has decided to change the name of the company or what it does or simply decides to terminate our services with out a reason or If several services are purchased together and the client decides to terminate the projects which have not started yet or the client does not give a valid reason for not liking the concepts or Even if the client is not 100% happy with the final design, if the client requests for the final files or communicates in any way their intent of completing the project or If the company is shut down or If the client has decided to change the entire requirement project scope or If the client has NOT communicated with us for more than 48 days or If the client requests for a fresh set of concepts (redraw) after the initial concepts - then there will be no refunds what so ever.

7) A project is deemed to have been completed if the client requests the final files. It is the responsibility of the client to ensure that all final designs are up to their satisfaction and are error free. Any errors in designs or typos that are not pointed out by the client at the finalization stage are not the responsibility of the designer or LDW as a company. A project is deemed complete if the client in any way communicates with us that they want to complete the project or by asking for a final design. We do not offer any support in terms of design changes after a project is complete and the client has been given the final files. We do however will help the client get the final files again at a later date (in case they lose the files or they get corrupted etc) for a small fee (as determined at that time).

Terms: Refunds and Cancellations

8) Refunds: Refunds are made in accordance with the refund policy in effect for each package at the time or at the discretion of the management. No refunds are made after the initial design concept phase. LDW would proceed after the initial design phase once the client has indicated they would like to proceed with the project by asking for a redraw or a revision. The balance of the project amount is charged at this time.

Terms: Copyright Issues

9) The CLIENT shall own 100% copyrights to the FINAL design that has been approved by the CLIENT. All other designs and concepts resulting from the logo design process shall remain the exclusive copyright of Logo Design Works. Any use of this work project by THE CLIENT is prohibited without written, prior permission by LDW.

10) Logo Design Works retains the right to utilize ANY artwork, designs, edits, revisions and work product from THE PROJECT in advertising, promotion and other marketing materials. Logo Design Works agrees to add a Trademark, Copyright or other ownership mark as may be requested by THE CLIENT from time to time. Further more Logo Design Works reserves the right to publish any comment/feedback/testimonial that the client sent the company on the LDW website or any other promotional material and sister websites. LDW shall have the right to include a credit line with live link to LDW website on any website developed by Spellbrand at the very bottom of each page or in any publication of the design by the Client. The Client shall not, without written approval, use LDW name for promotional or any other purposes with respect to these designs/websites.

11) Logo Design Works is NOT liable for any damages or expenses incurred by the client in the use of artwork created by LDW.

12) Due to the complexities of international copyright and logo trademark law, Logo Design Works will not be held liable should THE CLIENT be found to be infringing on an already existing copyright or trademarks or service mark relating to the project icon, project name, description or service. THE CLIENT should conduct a copyright and/or trademark search. Alternatively the client can engage (for a fee) Logo Design Works to do this search on their behalf. If the client is required to retract or change the logo (because it is similar to an exisiting design), Logo Design Works is not liable for any costs or damages.

Terms: About Bonuses and post-project support

13) LDW retains the right to cancel any bonuses published on the website at any time. Customers who had purchased packages which included the bonuses prior to any cancellation will be entitled to the bonuses. For printing related bonuses, LDW reserves the right to cancel them during or after the project if an issue crops up with the printing company. A reumbersement is entirely at the discretion of the company.

14) Once a design project (logos, stationery, website, brochures, mascot etc) is completed LDW will provide the final source files of the project as a download from our servers for a limited period of 48 hours. These files are industry standard files and we take every care to ensure the files are correct and functional. If for some reason outside the control of LDW (such as when the client's computer has a problem or the client does not have the required software to open the files) the client is not able to open the files, or the files, system or application created by LDW is messed up due to negligence, LDW will NOT provide support troubleshooting the client's computer, website, application or system.

Terms: Payment and Turnaround times

15) The project can take any where from a few hours to 24 hours to be initiated after payment is received. Project finalization and wrap up can take up to 3-4 business days before the client receives their final files. Our designers will try their best to stick to the project milestone timescales as indicated on the studio floor, however some times due to factors beyond the control of the designer, the milestones might be missed.

16) The project is charged at the rate that is in effect at the time the project is accepted by LDW and is not affected by any subsequent changes to the rates. Projects may require a signed payment authorization form, or telephone payment verification before scheduling.

17) For payment options please read our payment details page. Logo Design Works reserves the right to cancel any order and refund the amount paid before starting the project. Further more Logo Design Works is not liable for loss of the fee paid due to transactions being lost with the payment processors (PAYPAL, PROTX and 2Checkout) or any other related problems. LDW also will not issue an invoice or receipt other than the one that is sent out after the client completes the project questionnaire.

18) For resellers (i.e if you are not the direct client but are ordering our services for your clients) we charge the full amount prior to starting any work. There will be no refunds of any sort.

19) A projects is deemed to be finalized if the client does not get back with change request with in 3 days of posting the initial concepts or any revision round.
